SHOEGSM PRIVATE LIMITED - Terms and Conditions of Use

Welcome to Shoegsm! These Terms and Conditions ("Terms") govern your use of the website https://shoegsm.shop and its related mobile applications (collectively, the "Platform"), owned and operated by SHOEGSM PRIVATE LIMITED ("Company," "we," "us," or "our").

By accessing, browsing, or using the Platform, you agree to be bound by these Terms, along with our Privacy Policy and Return & Refund Policy. If you do not agree to these Terms, please do not use the Platform.

1. User Eligibility and Account Registration

1.1. Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform or place an order. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian. 1.2. Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials (username, password, etc.) and for all activities that occur under your account. You agree to notify Shoegsm immediately of any unauthorized use of your account. 1.3. Accuracy of Information: You warrant that all information you provide during registration and checkout (including contact details and shipping address) is truthful, accurate, and complete.

2. Product Information and Orders

2.1. Product Descriptions: We strive to ensure product descriptions, images, and prices are accurate. However, we do not guarantee that product descriptions are entirely error-free. If a product offered by Shoegsm is not as described, your sole remedy is to return it in unused condition as per the Return & Refund Policy. 2.2. Pricing and Availability: All prices are subject to change without notice. Product availability is not guaranteed. We reserve the right to refuse or cancel any order at our sole discretion, including those with pricing errors or where product stock is depleted. If we cancel an order after your payment has been processed, we will issue a full refund. 2.3. Intellectual Property: All products (including designs, logos, and collaborations) sold on the Platform are protected by copyright, trademark, and other intellectual property laws.

3. Payments and Billing

3.1. Payment Acceptance: We accept various payment methods as indicated on the Platform. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Platform. 3.2. Payment Security: All payment transactions are processed through secure, PCI DSS compliant third-party payment gateways. We do not store your full Sensitive Personal Data (such as complete credit card numbers). 3.3. Taxes: Prices displayed are inclusive of Goods and Services Tax (GST) or other applicable taxes, unless otherwise stated.

4. User-Generated Content (UGC)

4.1. Responsibility for UGC: You are solely responsible for any content (including reviews, comments, photos, or testimonials) you submit, post, or upload to the Platform. 4.2. License Grant: By submitting UGC, you grant Shoegsm a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute the UGC for promotional and business purposes, in any media. 4.3. Prohibited Content: You agree not to submit UGC that is illegal, defamatory, obscene, threatening, infringing on intellectual property, or otherwise injurious to third parties.

5. Prohibited Conduct and Platform Use

You agree not to use the Platform for any purpose that is prohibited by these Terms or applicable law. Prohibited conduct includes, but is not limited to: a. Accessing data not intended for you or logging into an account you are not authorized to access. b. Attempting to probe, scan, or test the vulnerability of the system or network. c. Using any automated system, such as "robots," "spiders," or "scrapers," to access the Platform. d. Interfering with service to any user, host, or network, including via submitting a virus, overloading, or "flooding." e. Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity.

6. Intellectual Property Rights

6.1. Platform Content: All content on the Platform, including text, graphics, logos, images, software, and collective work (excluding User Generated Content), is the property of SHOEGSM PRIVATE LIMITED or its licensors and is protected by Indian and international copyright laws. 6.2. Trademarks: "Shoegsm," the Shoegsm logo, and other marks indicated on the Platform are trademarks of the Company. You may not use these trademarks in connection with any product or service without the prior written consent of Shoegsm.

7. Disclaimers and Limitation of Liability

7.1. Disclaimer of Warranties: THE PLATFORM AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SHOEGSM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 7.2. Limitation of Liability: IN NO EVENT SHALL SHOEGSM PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM OR PRODUCTS PURCHASED. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCTS OR SERVICES IN QUESTION.

8. Indemnification

You agree to indemnify, defend, and hold harmless SHOEGSM PRIVATE LIMITED, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your access to or use of the Platform; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

10. Miscellaneous

10.1. Severability: If any provision of these Terms is deemed invalid, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. 10.2. Entire Agreement: These Terms constitute the entire agreement between you and Shoegsm regarding the use of the Platform.

Return and Refund Policy

SHOEGSM PRIVATE LIMITED - Return and Refund Policy

This Return and Refund Policy ("Policy") outlines the procedures for returning products purchased on the Shoegsm website (https://shoegsm.shop) and its mobile applications (the "Platform"). This Policy is in compliance with applicable consumer protection laws in India.

1. Overview of Return Eligibility

1.1. Return Window: Products are eligible for return within 7 (seven) calendar days from the date of delivery. 1.2. Eligible Conditions: A product is eligible for return only if it meets the following conditions: a. It is in the same condition that you received it (unused, unwashed, and undamaged). b. It is in its original packaging, including the original brand box, tags, labels, and all accessories (e.g., extra laces, dust bags, authenticity cards). c. It has no signs of wear, stains, alterations, or damage. For footwear/sneakers, the sole must be completely clean and unworn. d. The original invoice or proof of purchase must be included. 1.3. Non-Returnable Items: The following items are NOT eligible for return or exchange: a. Products marked as "Final Sale," "Non-Returnable," or "Clearance." b. Custom-made, personalized, or altered products. c. Intimate apparel, innerwear, swimwear, or personal care/grooming items (for hygiene reasons). d. Digital products or gift cards. e. Products damaged due to misuse or failure to follow washing/care instructions.

2. Return Process

2.1. Initiating a Return: To initiate a return, you must log into your Shoegsm account, navigate to the "Order History" section, and select the item(s) you wish to return. 2.2. Return Authorization: All returns require a Return Authorization (RA) number, which will be generated upon successful submission of your online request. Do not ship the product without an RA number. 2.3. Reverse Pickup: We offer a free reverse pickup service for most locations. The courier partner will attempt to pick up the item within 3-5 business days of RA generation. If reverse pickup is not available in your area, you will be required to ship the product to our warehouse using a reliable courier service. 2.4. Shipment Address (Self-Ship): If you are required to self-ship, please send the product to: SHOEGSM Returns Department[Insert Warehouse/Return Address] [Insert City, Pin Code] Note: Please ensure the RA number is clearly marked on the exterior of the package. 2.5. Inspection: Once the returned item is received, it will undergo a mandatory quality check by our team. This inspection takes approximately 2-3 business days.

3. Refund Policy

3.1. Eligibility Confirmation: A refund is processed only after the product successfully passes the quality inspection confirming the return conditions (Section 1.2) have been met. 3.2. Refund Method: Refunds will be processed back to the original payment method used for the purchase. a. Prepaid Orders (Credit Card, Debit Card, UPI, Net Banking):The refund will be credited back to the source account within 7-10 business days after the inspection is complete. b. Cash on Delivery (COD) Orders: The refund amount will be credited to your bank account via NEFT/UPI. You will need to provide accurate bank account details during the return initiation process. This process typically takes 10-14 business days. 3.3. Non-Refundable Costs: Shipping charges (if applicable to the original order) and COD service fees are generally non-refundable.

4. Exchanges

We currently do not offer direct exchanges. If you wish to exchange a product for a different size or item, you must initiate a return for the original item (Section 2) and place a new order for the desired product.

5. Damaged or Incorrect Products

5.1. Reporting: If you receive a product that is damaged, defective, or incorrect, you must report the issue within 48 hours of delivery by contacting our Customer Support team. 5.2. Resolution: Upon verification (which may require photographic evidence), we will arrange for a reverse pickup and offer you the choice of a full refund or a replacement (subject to stock availability) at no extra cost.

6. Cancellation Policy

6.1. Cancellation Window: Orders can be cancelled by the User within 6 hours of placement, provided the order has not been dispatched from our warehouse. 6.2. Post-Dispatch Cancellation: If the order has already been dispatched, it cannot be cancelled. You must wait for delivery and then initiate a return as per this Policy (Section 2). 6.3. Refund for Cancellation: If a prepaid order is successfully cancelled, the refund will be initiated immediately and reflected in your source account within 5-7 business days.
